Childhood obesity is in important respects a result of legal policies that influence both dietary intake and physical activity. The law must shift focus away from individual risk factors alone and seek instead to promote situational and environmental influences that create an atmosphere conducive to health. To attain this goal, advocates should embrace a population-wide model of public health, and policymakers must critically examine the fashionable rhetoric of consumer choice.

We show that the theory of the partial ordering of recursively enumerable Turing degrees is undecidable and has uncountably many 1-types. Imitation is said to be the sincerest form of flattery. Socially, the proposition may well be true. But in the world of ideas it is false: to the extent that two incompatible traditions use the same words or symbols to articulate different visions of legal or social organization, imitation begets confusion, not enlightenment. The effects of that confusion, moreover, are not confined to the world of ideas, but spill over into the world of politics and public affairs. Words are more (...) than tools of description: they work also as tools of persuasion and transformation. Let a term have a favorable connotation in one context, and its imitative use can mislead people into thinking that a major departure from established practice is merely the extension or updating of an old principle to deal with new circumstances. With this book, Richard A. Epstein provides a spirited and systematic defense of classical liberalism against the critiques mounted against it over the past thirty years. One of the most distinguished and provocative legal scholars writing today, Epstein here explains his controversial ideas in what will quickly come to be considered one of his cornerstone works. He begins by laying out his own vision of the key principles of classical liberalism: respect for the autonomy of the individual, a strong (...) system of private property rights, the voluntary exchange of labor and possessions, and prohibitions against force or fraud. Nonetheless, he not only recognizes but insists that state coercion is crucial to safeguarding these principles of private ordering and supplying the social infrastructure on which they depend. Within this framework, Epstein then shows why limited government is much to be preferred over the modern interventionist welfare state. Many of the modern attacks on the classical liberal system seek to undermine the moral, conceptual, cognitive, and psychological foundations on which it rests. Epstein rises to this challenge by carefully rebutting each of these objections in turn. For instance, Epstein demonstrates how our inability to judge the preferences of others means we should respect their liberty of choice regarding their own lives. And he points out the flaws in behavioral economic arguments which, overlooking strong evolutionary pressures, claim that individual preferences are unstable and that people are unable to adopt rational means to achieve their own ends. Freedom, Epstein ultimately shows, depends upon a skepticism that rightly shuns making judgments about what is best for individuals, but that also avoids the relativistic trap that all judgments about our political institutions have equal worth. This paper compares and contrasts relational quantum mechanics with a pragmatist view of quantum theory. I first explain important points of agreement. Then I point to two problems faced by RQM and sketch DP?s solutions to analogous problems. Since both RQM and DP have taken the Born rule to require relative facts I next say what these might be. My main objection to RQM as originally conceived is that its ontology of relative facts is incompatible with scientific objectivity and undercuts (...) the evidential base of quantum theory. In contrast DP?s relative facts have all the objectivity we need to accept quantum theory as scientific knowledge. But a very recent modification to RQM has successfully addressed my main objection,bringing the two views into even closer alignment. (shrink)

One of the most distinguished cultural and intellectual historians of our time, Frank Turner taught a landmark Yale University lecture course on European intellectual history that drew scores of students over many years. His lectures—lucid, accessible, beautifully written, and delivered with a notable lack of jargon—distilled modern European history from the Enlightenment to the dawn of the twentieth century and conveyed the turbulence of a rapidly changing era in European history through its ideas and leading figures. Because little is known about the human trait of affiliation, we provide a novel neurobehavioral model of affiliative bonding. Discussion is organized around processes of reward and memory formation that occur during approach and consummatory phases of affiliation. Appetitive and consummatory reward processes are mediated independently by the activity of the ventral tegmental area (VTA) dopamine (DA)–nucleus accumbens shell (NAS) pathway and the central corticolimbic projections of the u-opiate system of the medial basal arcuate nucleus, respectively, although these two projection (...) systems functionally interact across time. We next explicate the manner in which DA and glutamate interact in both the VTA and NAS to form incentive-encoded contextual memory ensembles that are predictive of reward derived from affiliative objects. Affiliative stimuli, in particular, are incorporated within contextual ensembles predictive of affiliative reward via: (a) the binding of affiliative stimuli in the rostral circuit of the medial extended amygdala and subsequent transmission to the NAS shell; (b) affiliative stimulus-induced opiate potentiation of DA processes in the VTA and NAS; and (c) permissive or facilitatory effects of gonadal steroids, oxytocin (in interaction with DA), and vasopressin on (i) sensory, perceptual, and attentional processing of affiliative stimuli and (ii) formation of social memories. Among these various processes, we propose that the capacity to experience affiliative reward via opiate functioning has a disproportionate weight in determining individual differences in affiliation. We delineate sources of these individual differences, and provide the first human data that support an association between opiate functioning and variation in trait affiliation. I.WhatVintage ofCivilRights?In this paper I wish to compare and contrast two separate conceptions of civil rights and to argue that the older, more libertarian conception of the subject is preferable to the more widely accepted version used in the modern civil rights movement. The first conception of civil rights focuses on the question of individual capacity. The antithesis of a person with civil rights is the slave. But even if individuals are declared free, they are nonetheless denied their civil rights (...) if they are unable to own property, to enter into contracts, to make wills, to give evidence, and to sue (and be sued) in courts. With all these civil rights claims, the target of the individual grievance is the state; it has denied large classes of individuals the formal capacities that it recognized and protected in others. The Civil War was fought largely over slavery. In its aftermath, civil rights claims protecting individual capacity received explicit, if imperfect, statutory and constitutional protection. The postbellum protections didnotguarantee these rights in absolute fashion – that is, in a way that would not be susceptible to abridgment under any circumstances. Instead, civil rights were protected in what might be called a relative fashion: whatever rights of this sort were enjoyed by white citizens were to be enjoyed by the newly freed black citizens as well. Where is rapid economic growth taking us? Why has its spread throughout the world been so limited? What are the causes of the great twentieth century advance in life expectancy? Of the revolution in childbearing that is bringing fertility worldwide to near replacement levels? Have free markets been the source of human improvement? Economics provides a start on these questions, but only a start, argues economist Richard A. Easterlin. This research is an extension of Walker Information’s (Business Ethics: Ethical Decision Making and Cases, pp. 235–255, 1999) study on employees’ job attitudes that was conducted exclusively in the United States. Walker Information found that the reputation of the organization, fairness at work, care, and concern for employees, trust in employees, and resources available at work were important factors in an employee’s decision to remain with his or her company. Our sample includes 713 students from seven countries: Canada, Colombia, Ecuador, (...) Hong Kong, Ireland, South Africa, and the United States. When analyzing the entire sample, our data indicate that both social desirability response bias and gender were significant; however, this was not the case when the data are analyzed by country. On an individual country basis, our data suggest that the generally accepted premise that women are more ethically conscious than men was only true for the samples from the United States and Canada. The data also indicate that, while social desirability response bias was significant for the four factors suggesting ethical components for the sample from the United States, this finding was not universal. In this essay we contend that traditional theories of argument are consonant with and enrich the project of postmodernity. Reading postmodernity as ‘a rhetoric’ underscores how the process of discursively resolving conflicts is occasionally threatened by politically motivated efforts to misuse the methods of argument; it alerts us to the egregious acts that are and can be performed ‘in the name of,’ but not because of, rationality. Postmodernity is thus an attempt by a new generation of theorists to recast and (...) draw attention to perennial philosophical problems in the context of contemporary political difficulties. Cloth, $35.00.Susan James shows how during the seventeenth century philosophers moved from the three souls of Aristotle and the tripartite soul of Thomas Aquinas in which passions and reasons compete for the attention of the will, (...) to a Cartesian view of man as a single soul in union with the body who wills under the influence of both passions and reasons, to a Hobbesian view that the soul is the body and that the bodily motions we call reasons and passions are desires; acts of will are merely the deciding desires in deterministic causal sequences of the material motions of the body that constitute desires. This sets up the contemporary view that, motions are caused by desires and beliefs, leaving behind the difficulties of integrating with one another Aristotelian souls, Thomistic faculties, and Cartesian mind and body. James conceives of this evolution as one of unification of mental and bodily powers, and of integration of the active and passive powers of the mind. This concourse also represents a development from theories meant to explain to theories calculated for control and finally to theories facilitating therapy. Aristotle and Thomas adapted their ontologies to perceived differences in powers and faculties, while Descartes and Hobbes worked toward an ideal of unity of science and nature. The Christian Descartes brought together all the substances and powers of nature under a single extended matter divided into parts by the single force of motion, but he excepted the human soul with its power of will to alter the course of nature. The atheist Hobbes simply dispensed with supernatural [End Page 168] mental substance and occult power of will in order to integrate the whole of nature (including sensing and reasoning) under a cause and effect sequence of moving material bodies in which the last desire in a sequence of human bodily motions is designated as an act of will.James intends her book “as a contribution to the reinstatement of the emotions within philosophy, to the… opinion that we need to take account of our emotional life if we are to understand… moral motivation and growth, the springs of action (rational and otherwise), and the nature of reasoning” (22). She agrees that the sharp division between ideas and passions or emotions is properly abolished to be replaced by the view that all ideas have an emotional component, and all passions an ideational component. This fits with the parallel development of the notion that all sensible perceptions are propositional, and the somewhat less widespread notion that all concepts have a sensible component.But did this development result in a view of passions and ideas, learning and knowing, thinking and action, that is more true to nature than Aristotelian ontology? It is very hard to answer this question, and despite her sympathies with the notion that all human thought is both conceptual and emotional, James does not try. The reason we don’t know lies under the surface of the movement from Aristotle to Hobbes (i.e., to Daniel Dennett) like a monster in the deep. The monster is the monotheistic God, the perfection and unity of which underlies the Western drive to a unitary view of nature including man. The possibility that this God could be a deceiver, and so all our sensations and ideas might not represent the real world, set up Cartesianism and modern hypothetico-deductive science. But lurking throughout James’ book is a more palpable dreadnought, a demoness, the woman Eve. The female is responsible for the Fall of Man, and thus the fear and suspicion of women that suffuses patriarchic Christianity, and is expressed openly by such philosophers as Malebranche. Bodily passions and emotions (particularly the concupiscent ones) are nasty, evil, irrational, overpowering; to wit, they are feminine. They are not to be trusted, and must be subdued. So while still driven by ideals of monotheism, Descartes and Hobbes do move beyond the dogmatic Christian association of the emotions with female treachery. Even so... (shrink)

The reputation and influence of Emmanuel Levinas has grown powerfully. Well known in France in his lifetime, he has since his death become widely regarded as a major European moral philosopher profoundly shaped by his Jewish background. A pupil of Husserl and Heidegger, Levinas pioneered new forms of exegesis with his post-modern readings of the Talmud, and as an ethicist brought together religious and non-religious, Jewish and non-Jewish traditions of contemporary thought. Richard A. Cohen has written a book which (...) uses Levinas' work as its base but goes on to explore broader questions of interpretation in the context of text-based ethical thinking. Levinas' reorientation of philosophy is considered in critical contrast to alternative contemporary approaches such as those found in modern science, psychology, Nietzsche, Freud, Husserl, Heidegger, Sartre, Merleau-Ponty, Derrida and Ricoeur. Initial evidence suggests that suppressing a thought prior to sleep results in subsequent dreaming of that thought. The present research examined the influence of cognitive load on dreaming following suppression. In Experiment 1, 100 participants received either a suppression instruction or no instruction for an intrusive thought prior to sleep, and subsequently completed a dream diary. Participants instructed to suppress reported dreaming about the target thought more than controls; dream rebound was predicted by poorer performance on a working memory task. (...) In Experiment 2, 126 participants received either a suppression instruction or no instruction for an intrusive thought prior to sleep, and half of participants also had cognitive load of learning a 9-digit number. Participants receiving the suppression instruction under cognitive load reported greater dream rebound than other participants. These findings indicate that thought suppression prior to sleep leads to dream rebound, and this effect is enhanced by cognitive load. (shrink)
